ICC Arrest Warrant for Assad Imminent, Experts Say

Following the collapse of the Baath regime on December 8, evidence from mass graves and torture centers has emerged, strengthening the case for prosecution.
Currently, Syria’s non-participation in the Rome Statute complicates direct ICC jurisdiction. However, a new Syrian government could accept ICC authority or the UN Security Council could refer the case, provided there are no vetoes. Legal analysts emphasize that Assad faces potential charges for war crimes and crimes against humanity.
Despite being protected by powerful allies like Russia and Iran, experts argue that Assad’s position has weakened, making him a liability. Prosecution could proceed through various channels, including special courts or under universal jurisdiction.
