A federal appeals court on Wednesday ruled that former President Donald Trump’s executive order seeking to end birthright citizenship is unconstitutional, upholding a nationwide block on the policy, the CNN reported. In a 2-1 decision, the 9th U.S. Circuit Court of Appeals concluded that a universal injunction issued by a federal judge in Seattle was justified to protect the states challenging the order.
Judge Ronald Gould, writing for the majority, said the injunction was necessary to provide complete relief and avoid forcing states to overhaul their social service eligibility systems. The ruling marks the first time an appellate court has fully declared Trump’s executive order unconstitutional.
The decision emphasized that the order violated the Citizenship Clause of the U.S. Constitution and contradicted the 1898 Supreme Court precedent in United States v. Wong Kim Ark. Trump’s order had already been halted by a separate class-action ruling in New Hampshire.
The administration may now seek a review by the full 9th Circuit or appeal directly to the Supreme Court. The ruling follows the Supreme Court’s recent guidance urging lower courts to reconsider the scope of nationwide injunctions but found no overreach in this case.
