Austria: Legal and Human Rights Debate as “Awareness Phase” of School Headscarf Ban Begins

Austria has sparked widespread debate among civil society and human rights organizations with the launch of the awareness phase for the new law banning girls under 14 from wearing headscarves in schools.

The policy, which will begin full enforcement in the next school year, has raised concerns over potential violations of religious freedoms and the marginalization of Muslim students.

The Austrian Equal Treatment Authority and civil society groups in Vienna have reiterated their opposition to the law, warning that its implementation could exclude Muslim girls from educational environments. Legal experts have also indicated plans to challenge the measure in the Constitutional Court, which imposes fines of up to €800 for violations, with alternative imprisonment possible for persistent non-compliance.

Authorities are initiating the phase through explanatory discussions with parents before applying financial or legal penalties, in an effort to reduce direct confrontations with students and families. Meanwhile, calls have emerged for a major protest on 13 February to express opposition to the law.

Rights groups have criticized the ban as discriminatory, emphasizing that it threatens the religious freedoms of young girls. The awareness phase is intended as a preparatory stage before full enforcement, which could include fines or alternative sanctions for non-compliance.
