Grand Ayatollah Shirazi Discusses Principle of Non-Existence in Fiqh During Daily Scholarly Session

The daily scholarly session of Grand Ayatollah Sayyid Sadiq al-Hosseini al-Shirazi was held on Sunday, 30th of Rabi’ al-Thani. As in previous sessions, the Supreme Marja addressed various jurisprudential questions from attendees.

Regarding the implications of practical principles in cases of doubt, Grand Ayatollah Shirazi stated that in the entire jurisprudence, in any instance of doubt, the overriding principle is non-existence.

His Eminence continued, noting that there is only one exception: when in doubt about one’s ability, the overriding principle is the existence of that ability.

He emphasized that if someone is Mustati’ (financially capable) and intends to go on the Pilgrimage of Hajj, but doubts their ability to perform the rites, the overriding principle is that they can indeed perform the pilgrimage.
