US Court Ruling Upholds Right of Muslim Women to Wear Hijab in Booking Photos

A US federal court has ruled in favor of protecting the religious rights of Muslim women in custody, affirming their right to wear the hijab in official booking photographs, according to Council on American-Islamic Relations.

The decision, issued by a judge in Minnesota, requires the Federal Bureau of Prisons to delete previously taken photographs of a Muslim woman without her hijab, after finding that the policy violated her religious freedoms under federal law.

The case was brought on behalf of Muna Jama, a Somali-American Muslim woman who had been forced to remove her headscarf for booking photos and carry identification displaying the uncovered image. Her legal team argued that the policy imposed a substantial burden on her religious practice.

The court ruled that such measures breach protections under the Religious Freedom Restoration Act, which prohibits the government from imposing unnecessary restrictions on religious expression without compelling justification.

Civil rights advocates described the ruling as a significant precedent, emphasizing that detention facilities must respect religious practices while maintaining security. They added that the decision could influence policy changes across correctional institutions nationwide.

The ruling marks a broader step in ongoing legal efforts to address religious discrimination and reinforce protections for individual freedoms within the US justice system.
