The UN Human Rights Council (UNHRC) opened its 60th session in Geneva, reviewing a comprehensive report by the UN High Commissioner for Human Rights (OHCHR) on the death penalty. The report, which summarizes a high-level panel discussion, highlights the global divergence between countries that have abolished the death penalty and those that retain it for reasons of deterrence or retribution.

The OHCHR emphasized that the ultimate goal is to assess global trends and analyze the human rights impact of continued use, particularly amid risks of judicial errors and lack of fair trial guarantees in some nations. The report noted a rise in the number of states that have fully abolished the penalty or implemented a de facto moratorium, reflecting a growing recognition that it violates the right to life.

Critically, the OHCHR warned that the finality of the punishment makes any miscarriage of justice irreversible, citing cases of individuals exonerated years after being sentenced to death. It also noted that vulnerable groups, such as the poor and minorities, are disproportionately subjected to harsh sentences due to limited legal defense options.

The UNHRC was urged to ensure the death penalty is not used as a tool for political repression. The OHCHR recommended that member states impose an immediate moratorium as a first step toward full abolition, ensure fair trials and free legal aid, and prohibit the application of the sentence to minors and those with intellectual or psychosocial disabilities.
