Grand Ayatollah Shirazi discusses khums ruling during daily scholarly session

The daily scholarly meeting of Grand Ayatollah Seyyed Sadegh al-Hosseini al-Shirazi was held on Saturday, the 11th of Shawwal. In this session, like the previous meetings, the Marja answered the questions of the attendees about various jurisprudence issues.

In relation to the necessity of paying khums to the completely qualified jurist, Grand Ayatollah Shirazi said: People who believe in khums but do not want to pay it to a completely qualified jurist or his representatives, rather they wish to personally spend their khums directly on cases such as helping the poor, their action is not correct based on Sharia.

His Eminence continued: If these people were present during the time of Imam al-Sadiq (peace be upon him) and would say, “I do not want to pay my khums to the Infallible Imam,” then their actions were definitely not legitimate.

He also emphasized: It has been narrated from Imam Masoom (peace be upon him) that: (In the events that happen, refer to the narrators of our hadith because they are my Hujjat (proof) upon you and I am God’s Hujjat upon them).

Grand Ayatollah Shirazi explained the meaning of this narration and said: This narration tells that the jurists are in the Imam’s place during the absence of the Infallible Imam. Therefore, just as it was necessary to pay khums to the Infallible Imam during their presence, or use it only with their permission, it is necessary to pay khums to the truly qualified jurist or to obtain permission from him during the occultation of the Imam.
