Grand Ayatollah Shirazi remarks on Divine Hudud during daily scholarly meeting
The daily scholarly session of Grand Ayatollah Seyyed Sadegh al-Hosseini al-Shirazi was held on Thursday and Friday 21st and 22nd of Dhul Qa’dah. In this session, like the previous meetings, the Marja answered the questions of the attendees about various jurisprudence issues.
On the decree requiring people to observe hijab, Grand Ayatollah Shirazi said: Divine Hudud, which are among the most important obligations, were suspended in thousands of cases during the government of the Messenger of God and the Commander of the Faithful, peace be upon them. Thus, if the requirement in question, which is among less significant issues, causes anti-Islam sentiments among the people, even among the disbelievers, it is not permissible to implement it.
Referring to the saying of the Masumeen, peace be upon them, who did not consider it permissible to delay even one hour in the implementation of the Divine Hudud, the Marja said: Despite the emphasis, we see that in many cases, for the sake of the society and to avoid creating hatred in the people and even the disbelievers and hypocrites towards Islam, the implementation of Hudud were completely suspended.
In relation to the existence of the “Government Order” during the time of the Holy Prophet, peace be upon him and his family, and his using of it, his Eminence said: Although some jurists have said in this regard that the Holy Prophet, peace be upon him and his family, used the Government Order in some cases, the predominant opinion is that the rulings were not Government Orders and, rather, were “Actual Rulings”. Therefore, all the rulings issued by the Holy Prophet, peace be upon him and his family, were not “Governmental”, even in the case of disputes.
