Canada: Court Appeal Raises Concerns over Delays to New Mosque Construction in Alberta

\nThe Muslim Association of Saint Albert has expressed disappointment after Alberta\u2019s Court of Appeal agreed to hear a legal challenge concerning plans to build a new mosque in Campbell Business Park, raising concerns about further delays to a project intended to serve the city\u2019s growing Muslim community.<\/p>\n
Association President Jalal Tarabin said the organization respects the court\u2019s decision but is frustrated by the prospect of prolonged legal proceedings. He stressed that the community\u2019s existing facilities can no longer accommodate the growing number of worshippers or meet its religious and social needs.<\/p>\n
The legal challenge was filed by businessman Gary Acheson, who raised concerns about traffic, parking, and the mosque\u2019s compatibility with the surrounding commercial and industrial area. Although a local appeals board previously rejected his objections and upheld the project\u2019s compliance with municipal regulations, the Court of Appeal agreed to examine whether the board properly considered the area\u2019s development and planning framework. It rejected a separate challenge concerning capacity and parking.<\/p>\n
The proposed mosque is designed to accommodate approximately 530 worshippers and provide 140 parking spaces. Tarabin also questioned the scrutiny facing the project, noting the presence of two churches in the same area and calling for Muslim residents to have access to adequate religious facilities.<\/p>\n
The court\u2019s decision does not cancel the existing approvals but opens another stage of legal proceedings.
