An Indian court rejects a Shia student’s request to wear a hijab along with the school uniform<\/p>\n
The Allahabad High Court in the Indian state of Uttar Pradesh has rejected a request by a Shia Muslim student to be allowed to wear a hijab in addition to the school uniform, reaffirming the right of educational institutions to impose uniform clothing rules on students. <\/p>\n
The case involves an eleventh-grade student at a private school affiliated with the Central Board of Secondary Education (CBSE), who applied for permission to continue wearing the hijab, citing that she had been accustomed to wearing it since her childhood and that the school had permitted it during previous school years.<\/p>\n
The court ruled that imposing a standard school uniform aims to promote discipline and equality among students and to establish the institutional identity of the school, considering that applying dress code rules uniformly contributes to providing a religiously neutral educational environment.<\/p>\n
The court also stated that allowing the student to wear the hijab in previous years does not, in itself, create a permanent right that obliges the school to continue permitting it if the adopted dress code rules stipulate otherwise.<\/p>\n
The court noted that the student did not provide, in its assessment, sufficient religious or legal evidence proving that wearing the hijab is an obligatory religious practice that cannot be abandoned, which would justify exempting her from the school’s dress code rules.<\/p>\n
